Generative AI procurement is the fastest moving commercial event most enterprises will run this decade. Pilot to production cycles compress from twelve months to six. We advise on every GenAI commercial event that touches a global enterprise, from pilot framing through production renewal. The work falls into six clusters.

  • OpenAI Enterprise procurement. Token economics, seat based versus consumption pricing, model upgrade clauses, and data residency framing.
  • Anthropic Claude procurement. Enterprise terms, prompt caching economics, model version commitments, and bring your own key arrangements.
  • Google Gemini Enterprise. Workspace bundling, Vertex AI consumption, and contract term flexibility across the Google Cloud commitment.
  • Microsoft 365 Copilot and Copilot Studio. Per user pricing, capacity reservation, and integration with the existing Microsoft EA.
  • Custom platform contracts. Hyperscaler hosted models, fine tuning rights, IP indemnification, and exit clauses for proprietary fine tuned weights.
  • Always on cover. Vendor Shield for any GenAI contract dispute, audit, or commercial change of terms during the engagement period.

OpenAI Enterprise procurement

OpenAI's enterprise commercial model has matured rapidly through 2025 and into 2026. The published list pricing is no longer the operative number for large enterprise deals. Token discounts, seat based commitments, prepaid credit pools, and model upgrade rights are all on the table for sufficiently large commitments. Our economic interest is to get our clients the published pricing and the unpublished pricing in the same document.

We have run more than twenty OpenAI Enterprise engagements since the product line stabilised. Outcomes vary by token volume, use case mix, and contract term, but the pattern is consistent. Most clients can move headline pricing by twenty to forty percent through volume framing alone, and a further ten to twenty percent through term, data, and upgrade clause negotiation. Anthropic Claude procurement

Anthropic's enterprise sales motion is younger than OpenAI's, and the contract framework reflects that. Discount levels, prompt caching credits, and model version lock clauses are all live commercial levers in 2026. The right framework depends on use case mix, token volume, and the role of Claude in the broader AI stack.

We have advised on Anthropic deployments through AWS Bedrock, Google Cloud Vertex AI, and direct Anthropic enterprise contracts. The right deployment shape depends on the data residency requirements and the existing hyperscaler footprint.

Google Gemini Enterprise

Google has pulled Gemini into the Workspace bundle and into Vertex AI. The commercial framework reflects both motions, with seat based pricing for Workspace integration and consumption pricing for Vertex AI. The right framing depends on whether the AI capability is intended to augment a Google Workspace estate or to power a custom enterprise application.

Microsoft 365 Copilot

Microsoft 365 Copilot is the largest single AI procurement event most enterprises will run in 2026. The published price of thirty dollars per user per month does not reflect the commercial reality of large enterprise deals. Capacity reservations, EA integration, and pilot to production framing all change the unit economics materially.

We have run Copilot procurement engagements where the unit economics moved between thirty five and sixty percent off the published price through commitment, term, and EA integration. Data and IP clauses

The single most important conversation in any GenAI contract is not pricing. It is the data clause. Who owns the prompts, the responses, and the fine tuned weights when the contract ends? Most vendor templates are drafted in the vendor's favor and require active redrafting to put the enterprise in a defensible position.

We negotiate data residency, training data exclusion, prompt and response retention, model output indemnification, and fine tuned weight portability across all major GenAI vendors. Most GenAI engagements run in one of three shapes. Project work tied to a single vendor procurement, pilot expansion, or production renewal.
